Hello!
I am very new here so please forgive if I am covering something that has been discussed!
I am very new here so please forgive if I am covering something that has been discussed!
Basically - I have a capital one account, I missed 2 payments in July and august as my daughter was sick, she had 2 visits to A&E and was quite unwell for a bit.
i contacted capital one who said they would put my account into breathing space for a bit while I sort myself out.
I have been paying the minimum amount each month but the £90 arrears was going over each month.
I didn’t know that I had to pay it straight away that was my own problem and I hold my hands up.
I thought with me paying the minimum amount while in breathing space this would be ok.
i logged into my account to pay yesterday and the account has now defaulted - I hadn’t received any letters at all and I don’t know why.
I felt sick, still do, I have been on the phone to them all day.
they said the default was givin correctly which I understand. Me not thinking just didn’t assume the arrears was going down as a missed payment, and had I received the letter I would have sorted it there and then.
after a long discussion they said if I could provide medical evidence to prove my daughter was sick they could look into this. I went to the Doctors this morning and they printed off the 2 A&e visits it had in July.
would anyone be able to offer advice please? Would I be able to fight this or is it a dead end?
I feel sick and just looking for some positive outcomes!

You've been in arrears since July so it's likely they waited six months before defaulting you so they did follow guidance on that, though you should have received arrears and default notices.
If they have stopped applying interest (and if they haven't they should) then it will make this easier to repay, and for you to get debt-free
You could argue with them but is there much point?

I know, I think the whole situation has knocked me sick and I just feel like I am in a black hole.
They said they sent me default notice and a default letter but genuinely never received anything in the post and I have no idea why!
My account was put in breathing space and on my statement it did show the arrears, but also shown my minimum payment which I was paying and I paid over the minimum payment on 2 months. I actually went on yesterday to pay the full arrears amount and that’s when I noticed the default.
Just came as a shock, as I genuinely believed my minimum payments each month didn’t class as a missed payment, thought the arrears would just be a payment I needed to pay and when I came out of breathing space I would have paid - which I was planned to do yesterday!Hoping my daughters hospital letters prove why I missed the payment as that’s what they asked for but I think it’s done now, can’t see them changing their mind, and technically they don’t have to they have gave me 6 months, silly me just had my head in the clouds!0 -
Unless you're applying for a mortgage in the near future, this isn't going to make much difference.
There are a lot worse credit files out there than yours!
The media try to train people to worry about their 'score' - it really is meaningless. I never bother to check mine.0 -
To be honest, unless its important to you to keep a clean credit file, I wouldn`t bother.
Now the account is defaulted, all interest and charges will have stopped, making your ability to repay that much better.
They will not remove the default in any case, and even if they did, they may replace it with AP markers, (as the account status must show something) or even mark it as delinquent, your better off with the default.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. thanks for the replies
tbh my credit score is far from perfect but am working on it! A default just sets me back a lot a lot!I haven’t ever had a default or anything like that, had a couple of missed payments from the summer when my baby was in and out of hospital. Managed to sort it apart from this one from capital one, which I was paying mimimim payments each month and didn’t realise the arrears was classing as a missed payment each month - kicking myself0
