No we got a free valuation from our lender, the lender sent him, we have had no contact with him at all. We think the property is worth more than the £200k, as does the valuer.dimbo61 said:The bunny is out of the box now !

Broker convinced us to only ask for £200k from lender, and told me that if value came back higher we could adjust then (which I now know to be rubbish - the valuer would basically have only ever agreed with the £200k or down valued).That is not rubbish. However, when you are talking such fine margins, it seems pointless to try that.The valuer told the seller how much we had asked for, how much of that was mortgage and how much was deposit, and basically told them he would have had no issues valuing it even higherThat is a data protection breach. The valuer has no right to disclose your personal data to a third party without your consent. Purchase price is fine but the deposit and mortgage amounts were not.
You should complain to the lender. The lender itself didn't do anything wrong, as the valuer is a third party. However, the valuer was acting for the lender.
The complaint may go some way to help you to get the property revalued as it's clear you feel the valuer was unprofessional and the data protection breach has materially disadvantaged you.

The surveyor would not know how much you had applied for.
I think they would know what you had offered, but that would be it. If this is the case, then I reckon there is an argument the lender has breached data protection as the size of your deposit should play no part in the valuation.
Likewise the surveyor has also breached data protection by then sharing that detail with a third party.
