Introduction to my journey

  • Hi fatbelly

In answer to your points above.

    1. I didn't see an option to request support for the bankruptcy fee.

I did get a call today from Citizens Advice and have an appointment on Wednesday to apply for grants towards bankruptcy fees. I'm not aware which grants will be applied to.

I did try calling BGET however the automated telephone system stated that I needed to wait 4 weeks and that they will get back to me. I will check if there is an email on the portal.

Point 3. I'm not sure I qualify? But will attempt to reach out to my local council to touch base with an AMHP.

Point 2. Its a speeding fine. Charges are: Fail to give information relating to the identification of the driver / rider of a vehicle when required.
Exceed mph speed limit in contravention of a local traffic order - manned equipment.

Well, best of luck with the grant applications. I have to say that you could do with a plan B, which will involve you making payments from a card that eventually reach £680

Is there any mileage in grovelling on the speeding fine? Would you have been offered a speeding awareness course if you had responded? If you are found to be doing between 10% plus 2 and 10% plus 9* and you haven't done a course in 3 years, that's normally the best option.

    *so in a 30 zone that's between 35 and 42

Personally I'm not a fan of breathing space and feel you would be best to just get on and declare bankruptcy. If you have a AMHP who's prepared to do the work, fine. If you talk to stepchange they do do a lot of standard breathing spaces, which gives 60 days of no enforcement. But is anything actually being enforced?
  • I can provide an update British Gas Energy Trust came back saying that I didn't meet their criteria.

Citizens Advice helped me to apply to the Thames Water Trust Fund. www.twtf.org.uk

I already had a speed awareness course in the last 3 years - in April 2020.

There are a lot of people chasing a small amount of funding when it comes to bankruptcy fees.

The usual technique is to bung it on a card and let the chips fall where they may (Insolvency Service don't bother about this although it's against their guidance)
  • Hi

I am back to update and ask further questions. Thanks for forumites for replying earlier.
  • council tax

I saw on another forum post that council tax in bankruptcy should have been disregarded for the year the order was granted.

We continued to make payments to council tax from April 2023. My assumption was that it would only count for the new year.

However the payments were applied to the previous year.

Am I right that in the overall scheme of it the account was in both names it didn't make a difference as my partner would have had to pay this debt?

  • creditor not listed

So I have a debt that is being chased however having requested the list of creditors from the Insolvency service recently this specific creditor is not ont there.

The creditor has ignored emails I sent them stating that I have been made bankrupt. I emailed the Insolvency service again to ask what can be done about this

  • speeding fine

I wasn't able to attend but did send in representations before the court date. I asked to join virtually as I couldn't attend in person. No response was received. Not sure if or how my representations were taken into consideration

Outcome is that I have a speeding fine of 276.

I haven't made any payments as I don't have the means to.

The collection team at the courts won't go lower than 20 a month. It seems that they want for fines to be paid off in full within 1 year.

No notice received - a payment was taken out of universal credit in October. £28

A text message from cder debt collectors came in Nov 23 claiming amount owed £354. No details in text or website. I assume its related to this. I have asked cder for further proof of what debt they are chasing. Shouldn't someone have written to me about debt going to debt collectors?

I did complete an mc100 form to have the fine reviewed. But the courts don't seem to reply to my emails. Its been several months and no luck having the height of the fine reviewed in light of my financial circumstances

  • We currently have one vehicle at home.

I applied for my vehicle to be kept to do school runs and shopping.

My car is overdue on service, rear breaks, caliper and discs changed, tyres need to be replaced and timing belt changed.
Costs of £900 quoted fot car repair. Does not include cost of tyres.

Is there any funding available to help with this cost?

Car is important for my livelihood and still not sure how I will afford it. Everyday i drive fearing that it may breakdown. I've been putting it off the work that needs to be done for some time.
