  • Thanks Fatbelly. If my 6 years with the loan is over this week, could they still obtain a CCJ? Could they apply today or tomorrow and it reset the timer as such? If I’m honest that’s the one I’m scared of, as I’m hoping that after 4.5 years they won’t chase me on the CCJ. Finally feeling like my finances are in order, I have a credit card that I only use for monthly fuel, and pay in full monthly now, and everything else is paid for in cash.

    They have to send you a "letter before action" first to comply with civil procedure rules.

    This has a 30 day return window, so I would say you were in the clear with this one, it will have gone statute barred if there has been a clear 6 years since the date of default.

    The debt collection process doesn`t move as quickly as you may think it does.

  • Evening all, apologies for resurrecting an old thread. I have now passed the 6 years on the one of these, and believe it should be statute barred. However, I have now received a letter regarding the CCJ I received for the £6,482.82 I owed. This has come from Overdales Solicitors and is saying that they have been instructed to apply for a Warrant of Control. I’ve been given a couple of discount options. If I don’t accept within 10 days then the offer will not be extended. Failure to do so in the next days means a Warrant of Control will be issued.

    The CCJ was issued on 29-03-2019. However Overdales are acting on behalf of Lowell. 

    I guess my question is should I be worried? I have no way of paying the amount in full, or over 3 payments as they have to offered. Wondering what my next step should be?
