I hope I’m posting on the right section and I hope someone from @LandRegistry can help.
my late husband left his share of the house to his son as a life interest and we were tenants in common, when I take my late husbands name off on do I also have to put my sons on as he has a life interest but he doesn’t get anything until I die.

As per my question on your thread over on the deaths and probate board, are you sure you have you facts right here. The normal process is to leave your share to your children and a life interest to your spouse. You can’t leave your share to someone and a life interest to the same person. What exactly does your husband’s will say about the house?0

I haven’t got the Will at the moment but will check wording when I get it back but I believe my son has the life interest and I’m the life tenant, I can sell to upsize or downsize if I wish and any monies left over from a sale goes into a trust until my death.0

The person given the life interest IS the life tenant, so I am pretty sure you have misunderstood your husbands will. The life interest/share relates to your beneficial ownerships. The legal ownership passes to just you as the surviving joint owner.Just_caring said:I hope I’m posting on the right section and I hope someone from @LandRegistry can help.

As others have posted there’s no ‘have to’ and you may find you need do nothing more than update the register re the death.We can’t advise you as we deal with the legal ownership so only update that as and when such matters have been considered and a decision made“Official Company Representative
