They are explicitly referenced on their documentation.
    That's why I was asking.

Is that current documentation and/or letters? If so, then need to put that on their correspondence as this is now not in the 90s when the loan was taken out.

No need to get snarky.     I thought Edi81's comment was correct and fair.  There is no point looking at current regulators that didnt exist back when it was sold.

I asked a question, I got an answer.

And what, pray tell, am I supposed to do with "they need to.... "?!?
'They' may well 'need' to do all sorts of things!

I thought it was quite clear.

You said "They are explicitly referenced on their documentation".
The reply made it clear that they need to reference it in their documentation.
However, none of this means a pre-regulation sale is covered by current regulations.  This goes back to your earlier post where you said:
"If a mortgage lender has set itself up to be out of reach of the FCA I was wondering if any of the others might have been able to offer some sort of enforcement options".

The lender has not set itself up to be out of reach of the FCA.   Regulations and laws came in after the sale of the product.  So, you cannot retrospectively apply those regulations and laws to sales when they didn't exist.
