The reply made it clear that they need to reference it in their documentation.
However, none of this means a pre-regulation sale is covered by current regulations. This goes back to your earlier post where you said:
"If a mortgage lender has set itself up to be out of reach of the FCA I was wondering if any of the others might have been able to offer some sort of enforcement options".
The lender has not set itself up to be out of reach of the FCA. Regulations and laws came in after the sale of the product.
