    OK, so GMAC and Black Horse are the legal owners... but on the DVLA document it requires the signatures of both the previous and the new registered keepers. How do we get past that one?

    Apart from living in Scotland I’m basically in the same boat as yourself and your husband. I was made Bankrupt last May and handed my house keys to my trustee in November as I couldn’t afford to by out the equity which is currently 23K and stopped paying the mortgage.

    The Trustee put the house on the market and Northern Rock who the mortgage is with are currently threatening legal action and repossession.

    I told them I no longer live at the property, as I moved out to private rented in November.
    I also told them that they need to contact my trustee rather than me in reference to the sale.

    I have the same worries as you regard costs involved. If it goes to court and they repossess and sale will it go for less than the mortgage I owe on it. Then will I be left with a shortfall? Doubtful with the current equity but you never Know.

    Do I have the property voluntary repossessed to keep it out the courts to cut the costs down? I don’t want to attend court as it’s academic to the result and I will be out the country for 4 months anyhow with my job so to me voluntary repossession would seem the way to go, remembering to read and cross out any offending small print first in regards to costs liable by me.

    I find it hard to get straight answers on the above I contacted National Debt Line they said it’s not my problem let the Trustee and Northern Rock get on with it. My Trustee is behind a fortress of assistants and it is impossible to talk to her. I sent her a letter with my questions and concerns however still waiting on a reply.

    TO GET TO MY POINT!!!

    As you appear to be in the same position to me be it south of the border, if you get anywhere further down the line it would be good if you could tell me how it went for mutual support. I of course will update you on any changes and possible open advice as to our mutual situation.

    Hope the house is off your back out of the financial picture soon.

    definately do a search on debtdoctor and Registered Keeper as he explained this to someone else the other week.

    I also think at least one OP drove the car to the office of the finance company and put the keys throught the door. However that might bhave been a DFW rather then BK situation.
