    They are probably going to say no.  You will then have to take it to an employment tribunal and in months/years time if you do win will get 2 months salary paid.  Is it really worth it?

    Maybe be best to focus on getting another job.

    Also if you read this link then it does seem to indicate that you have not passed probation until you have received notification from your employer so not sure you will win

    The relevant bit is 

    "It’s also important to make a note of when the probation period will come to an end for an employee. If there isn’t a clause in their contract that says that you’ll provide confirmation if their probation has been passed, and they work beyond the probation period specified in the contract of employment, then there could be an argument that they’ve passed their probation by default."

    Your contract does that a clause that says your employer will provide confirmation that probation has been passed and this has not been provided.

    As a result not sure you will manage to get 3 months pay in Lieu.

    On the positive side if they had terminated your contact last month you would have got less salary than you have ended up with so there is a small silver lining.

    Might be more productive to negotiate for a positive reference, than pursue an extended notice period?

    Why not try it, you've got nothing to lose.

    I had an issue with a previous employer, I had worked for them for nearly 9 years, and I tried several different places to gain information and assistance. I was told I wouldn't get anywhere blah blah blah. Eventually I found an employment solicitor and took all my stuff to them and got a decent payout. 

    Although not the same as your issue but nothing ventured, nothing gained.
