I was given notice by my employer for my last day to be on the 27th of January. I made an appeal to my employer as I feel I’m being dismissed for whistleblowing and discrimination. Whilst I was working today my employer emailed me to say my appeal wasn’t successful, he said I’m being dismissed because of my performance however my performance has never been an issue or raised during one to one review meetings. He was annoyed I appealed and instead of me working he’s decided to put me on Garden leave an he said because I wasted his time with the appeal he’s thought about it and is no longer going to give me the extended date of 27th which I was supposed to work until but only pay me until the 3rd of January. My contract states that they only need to give me one weeks notice. Does anyone know if it’s ok for him to do this even though my termination letter says 27th.

    Give ACAS's helpline a call and have a chat with them. There's obviously more to it than the brief information in your various posts.
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!

    One weeks notice is only until the 21st December so if you complain again your employer may decide to only pay you for one week. 

    Might be best to just leave it be now.

    What type of "discrimination". Only certain types are protected in law and remove the need for two year's service to claim unfair dismissal.

    "Whistleblowing" can also be protected but the legal meaning of it is quite narrow.

    Almost certainly any company disciplinary "process" will not be a contractual entitlement. In the unlikely event that yours is, then you might be able to claim wrongful dismissal (no two years needed) which is basically breach of contract. However all that would get you is a few days pay for however long it would have taken to properly follow procedure.

    Unless either of the above qualify you to bring a claim for unfair dismissal, inside of two years, there is little you can do.
