How are holidays worked out when you get more than state min?

Recovery of overpaid statutory holidays requires a clause in the contract.
A company is not legally entitled to deduct excess holiday payments without that clause.0 -

So the calculation in question (25/12 x months worked) would not be allocating the statutory allowance. The BHs have to be considered. Whether ultimately a person was given the statutory allowance would depend on when the BHs occurred and whether or not they were worked.0 -
Asking your employer would seem to be the simplest starting point, particularly looking at the amount of speculation/various methods being outlined in reply to your question!beckysheffield said:
