Overdales Solicitors Help

Hi All

I had a CCJ back in 2017 through Lowell, it went to Overdales solicitors and I agreed to pay £20 Per Month.  I recently moved house and advised them of my change of address however they mentioned I actually have 2 accounts with them, my CCJ and another debt which I was unaware of but is not subject to a CCJ.  It seems that the £20 I have been paying towards my CCJ has been pro-rata applied to the other account they claim I hold with them so it seems they have bought another debt and just started paying it from the £20 I thought was going towards my CCJ.

I complained via email and they claim to have sent me letters, they also claim because I have been "paying" the debt I have been acknowledging it.  

I have tried to complain to Financial Ombudsman but they say they can't help because its a solicitors.

Any thoughts on whether it is possible to hold them to account for this ?  I was under the impression my CCJ would have been paid by now but alas it's nowhere near paid due to them buying another debt.

    Yes, not good practice by Lowell/Overdales, send an official written complaint to them.

    What was the judgement amount you had to pay on the CCJ debt, more or less than £20?

    Either way, you can go back to court and apply to change the payment amount to whatever is affordable to you, so you have the court agree a payment amount, then Lowell cannot split it between accounts.

    When they say you have been acknowledging the other debt, that is a meaningless statement from them, it would only affect the limitation period, nothing else, I would CCA that debt and see if they can produce compliant paperwork.
