Wife's IVA cleared but CCJ still showing as active

Hi all,

In April 2017 my wife had a CCJ issued against her but it was sent to an old address and by the time we found out about it it was too late to appeal. My wife then entered into and IVA to clear all of her debts and her CCJ. The IVA was paid off in June 2017. All debts settled.
Now in November 2022 the IVA is showing as discharged on her credit reports but the CCJ is still showing as active. Is this right?

My wife's credit rating is terrible but mine is really good. I'd like to have a joint account to manage household finances, but I don't want to ruin my credit rating by having a financial association. Also I feel it would really hamper us in terms of applying for a mortgage.

  • Someone will correct me if I’m wrong but I’m fairly sure that this is correct but it will drop off the credit file 6 years after it was applied.

    The IVA drops off 6 years after it started, similar to the ccj.

    Until then, your wife's credit history will not look good and you should avoid any joint product.

    It sounds like it will clear itself early next year.

    Unless the IVA paid the debts in full, it's a difficult argument to say the ccj should be marked satisfied, and it's not going to make much difference anyway.

    There is no way to mark a CCJ annulled by insolvency, so it will still show as active until the 6 years are up.

    The judgement itself is null and void, so no enforcement action can be taken.

    Its more likely you would have asked for the judgement to be set aside rather than appealing it. Not aware of a timelimit on doing this but water under the bridge now.
