Phishing letter from Hoist Finance?

Options
Back history. Long story short. In a previous relationship I had a mortgage and other debts. We had a secured loan on the house to pay off debts so were just left with loan and mortgage. The relationship broke down and it came to light my partner was not actually working (pretended to go to work) and subsequently our mortgage, council tax and various other things weren't being paid. This was 2008 the year of the financial crisis.

We eventually split up and abandoned the house for it to be repossessed. I then spent numerous years with no credit, a very bad credit rating etc. I am now in a much better position, married and with a decent credit score. Had cars on finance, credit cards ect.

Now this letter comes to my current address which is like 4 houses since my mortgage owned home. Asking am I the named person who used to live there. I'm guessing they've bought a debt portfolio and I'm in it? This is now over 14 years ago and me and my ex partner have not spoken or acknowledged anything we may have got in the past, eg mail. What could they possibly be after do you think? Surely any debt would be statute-barred? The loan i remember seeing on my credit rating with a zero balance so cant be that. The mortgage was with HSBC.

It says if you are the named person to contact them, and if not, also contact them.  :D

  • Did the amount the house sold for cover the secured obligations? Ie did it clear the mortgage and the secured loan, and pay anything back to you/your ex, or was there a shortfall?
Did any CCJs ever appear on your credit history can you recall?

This may well be a fishing trip - not least allowing for the amount of time that has passed and the amount of different places you have lived since then. It may not though, so the answer is possibly not straightforward!

  • i believe mortgage debt is statute barred after 12 years?
  • I have no idea what the house sold for, we did not get anything from said sale. When I search the property on right move etc it gives a valuation which is near triple what we paid due to the amount of time that has passed, but also has us as the last people that bought the house. So I guess it went for auction. I never had any CCJs appear on my credit file. The loan company did send letters to a previous address but I never replied to them and I distinctly remember the last one they ever sent which is a good few years ago, over 10 maybe, had a zero balance on it. The loan company no longer exist now either.

Yes it is - the capital portion.

Any interest owing is statute barred after 6 years.

In addition FCA rules say that you must be contacted within 6 years

At the moment this just sounds like fishing. If they allege that you owe them a sum then I think you'd respond with the statute barred letter.

    I'd ignore them until then.
  • UPDATE. Today I received a text from Hoist finance asking me to complete my account. Not sure where they got my phone number from as my number is in my wife’s name for no other reason than my wife works for the mobile network I’m on and she gets a staff discount. I suspect it’s best to keep ignoring.
  • Just tried calling me too. Didn't answer.
