Work Pay

I put in for 3 weeks paid time off a while ago and was all accepted and gone through I come back to work after and get my pay slip and they have not paid for 44 hours holiday saying I didn’t have enough entitlement

they say to use a specific site to ask for holiday which I did and it said I had the entitlement for it and still have entitlement left but now they are saying I should be checking another site. I have proof of the original site saying how much entitlement I have left

I have explained that I can’t afford not to not get paid this and that if I would of known at any point that it would be unpaid I would not of taken it as I said I need the money

is there anything I can do

You could ask them to pay some of the money now (they probably won't pay all of it) and set it off against future holiday entitlement as you 'earn' it. Point out clearly but politely that you:

    • followed the link they provided originally and that confirmed you had more than enough entitlement to cover the holiday you booked - give a screenshot to demonstrate
    • relied on the original link to confirm the position and would not have booked leave had the true position been known.
Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!
  • How long have you worked for this employer?
In the first year of employment they can say that they will pay only for holiday which has accrued.
That doesn't mean that you can't automatically take holiday but that only the portion you have "earned" is paid for at the time.
I think that may have happened in your case.
For example, if you are entitled to 28 days holiday for the year, but have worked there only 3 months at the time your holiday starts , you could actually be due to be paid 7 days of the longer holiday which has been booked.
