Birmingham Midshires pays compensation to mortgage customers - MSE News

Birmingham Midshires - now Bank of Scotland under Lloyds Bank - have made my life hell - they wrongly increased my CMI between Jul 2016 and Oct 2018 which amounted to them over charging me approx £32,000 during the 2yrs, as per the FCA ruling they reimbursed to the account but instead of the full amount of approx £32,000 they only reimbursed approx £24,000 leaving an amount of approx £9,500 still showing on the account which subsequently shows as 'Arrears' due to their error and I have never received any compensation.
I have been fighting with them to reimburse the remainder of balance and for compensation since 2018 - they have done nothing just keep taking me to court, now for the 3rd time.
I am currently in Court again tomorrow for a Claim for Repossession by them yet again due to these bogus 'Arrears' - I am having to represent myself, their solicitor keeps bombarding me with Witness Statements (4 to date) and leaving me little time to respond as their bundles are usually over 100 pages - I am going nuts at the worry yet again of my house being repossessed for 'Arrears' I don't owe - oh and they are slapping more costs onto the account for their solicitor fees and court fees. Also I Divorced in 2000 and they have also kept my ex-husband on the mortgage even tho he has paid nothing since 1997! and on an SVR Rate for 22yrs refusing to transfer/allow a remortgage to a Fixed Rate or Extend the Term.
I sent to the court and the Lenders solicitors a Witness Statement in my Defence with an excel spreadsheet showing all CMI interest charges from 2014 to date, and showed exactly when and where their error occurred - including all payments due and payments I have made - I also pay a small agreed amount monthly towards these arrears, even tho I should not be liable due to their error as I said.
As it is a joint mortgage and my ex refuses to give consent - the FOS are unable to help and I am awaiting a reply from the FCA with regard to their Ruling and the subsquent heavy fine they levied on the Lender when they didn't comply.
Has anyone else been in this position that can help me please? I also have a very vulnerable disabled daughter living with me who I care for.

You really do need a lawyer, CAB, a law centre etc to help. It's way outside the remit anyone here can offer opinions on as someone needs to go through all the paperwork and structure an argument to support what they discover.
