Have I lost my money?

I'm not sure if this is the right place to post ..

2 weeks ago I ordered some stuff from what seems to be a popular site - I was given an account with them where I can track the details of my purchase .. it says my order is 'pending' .. it's been saying that since day 2 - the same day the money left my bank :(
I've emailed the company .. even tracked the e-mails so know for definite they are receiving my messages, but, they just won't respond to me. Is there anything I can do legally to get my money back?

Forget to say - I paid with my visa debit card.

  • I don't want to say at the moment in case I make the situation worse - it's a small online company who sell game consoles and that kind of stuff.
    I just need to know if I can recover my money - it wasn't a huge sum, but it's going to spoil Christmas a bit if I have to take it as a loss.

    You're not going to get much advice, following the fact you've already Emailed them etc - if you don't say who it is? Presume you didn't purchase under the name of 'October' - so there's no read across!

    But - you always make online purchases on a Credit Card, it affords greater protection
    If you want to test the depth of the water .........don't use both feet !

  • I have my cards insured with card guard just in case...it has only happened to me once (thankgod) and I got all my money back...

  • Unfortunately Section 75 of the Consumer Credit Act doesn't apply to debit cards. You could try contacting your card supplier and tell them what has happened and see what they can do.

    Is there not a phone number for this company that you could call to discuss this issue. With the Christmas rush they may well have a back log of emails to deal with.

    Worst case scenario you could take them to the small claims court to recover your money. For doing this you need to contact them in writing first asking for a full refund or supply of the goods within a reasonable time-frame. Send all letters recorded delivery.

  • Thank you all so much for the advice - It seems the company had a hiccup with their database and were trying to retrieve customer information, payment records etc. I had a lovely sincere apology from the owner for the stress I was caused and my package was posted this morning .. I have a tracking number :j.. phew! my son gets his Christmas present! I've definitely realized the big downside to using my debit card online .. in future I will either use the credit card or paypal. I thought the debit card would be less of a risk - it's my basic bank account I use for online shopping so my 'life' savings don't get pilfered from my main bank account :rotfl:

    btw - it wasn't ozone.
  • I bought some stuffs once in ebay using paypal id. I didn't get the product for long so I contacted paypal. I got my money back. I wonder if there is any facility like that in Credit Cards too.

    Yes goods purchased between £100 and £25000 are covered under section 75 of the Consumer Credit Act.
    When you use a credit card for purchases there is joint and several liability between the retailer and the card company.
    If the shop for any reason fails to send you the goods you ask the card company to issue you with a refund with what is called a chargeback.
