Givenergy Battery Capacity Problems

I have a give Energy system and 9,5kv battery for first 3 months  from Install in April it was perfect , now its very glitchy, discharges from 100% to 4% overnight even when  no demand ,,,  does not seem to charge to full capacity  , it says 100% but its only really 60% ,,,

has all the latest firmware updates but  Give energy customer support admit there is a problem  , But they cant explain what it is , they said they may change the battery ??????  but are   probably bullshitting me ,,, The  warranty seems  useless ,  I am seriously thinking of taking legal action ???? as the product does not appear to be fit for purpose .
