FOS High Interest Loan Complaint

Hi all,

Just looking for some community opinions.

I recently had one complaint for a High interest loan upheld by the FOS so I decided to make another one for a second High Interest Loan taken out around 4 weeks before the upheld one. 

This one has not been upheld by the adjudicator and is now going to an ombudsman. One of the basis for this rejection is the loan company allegedly verified my income at a level where I would have had sufficient disposable income. Interestingly, the complain that was upheld about a loan taken out 4 days later, also verified my income independently and it came to £300-£400 less than the other verification.

My question to you guys is - should I reference this and the previous complaint in my additional representation to the ombudsman? I know each complaint is done on its own merits but I can't help but think that this income verification is far too wide in its gap to be ignored.

    Complaints are decided on their individual merits, but it seems unlikely that your circumstance would have changed that much in 4 days, so referencing the other complaint can`t hurt.

    There is no concept of precedent in the Financial Ombudsman and so you will find cases where seemingly almost identical cases have a different outcome. 

    You switch between saying the gap was 4 days and 4 weeks between the two loans but I am going to guess and say the first loan hadnt been paid off by the time you took the second one and so unless you had a payrise between the two the chances are the second loan will always have been more of a stretch for you than the first. 

    You can cross reference complaints if you want, remember all decisions made by ombudsman are published so plenty of people can quote third party's complaints to support their own, but they often come back with a response about lack of precedent
