OR contacting family members

Hello all,

I went bankrupt July this year and have just received an email from the OR asking for contact details for family members. 

My bank account shows transfers of £2100 and 2400 in the 6 months preceding but this was paying back for help to buy furniture for my new house before I got my salary. My total bankruptcy was 35k - mainly old debt sold to companies like Pra group/Cabot etc. I am on an nt tax ipa only.

I just wanted to know from other’s experiences if they contact all family members and try to get money back from them? (I haven’t told anyone that I am bankrupt and would like to try and keep it that way)

    I think they would check on large amounts like that. 
    My interview was face to face..doesn't happen much now. 
    The examiner looked at my bank statements for anything that jumped out

    I think the best thing would be to contact the OR to discuss this because it's something that needs to be properly explained. If you don't understand anything, or you want more information, then it's always best to contact the OR.

    I have had confirmation that they are writing to my family to check that the money was given for the reason stated. 

    Not sure if they will ask for it back or not (sent in October 21 and bankrupt July 22) with lots of other incoming and outgoings from same family members before and after. 

    Really didn’t want them to worry and I feel a right failure now ☹️

    These payments are "preferences" as you paid family members back in preference to other creditors. The legislation allows for the OR to claim these payments back from your family members as all creditors should be treated equally. The OR will write to them with this claim, hence asking for their contact details.
  • If it was paying back a loan to family members first then that’s not fair to other creditors
