CMS gross salary calculation and work benefits

Hi there,
I recently applied to the CMS and they have calculated my gross salary including my non payable benefits such as private medical. I appealed explaining this is not actually received as income by me but it has been rejected with no explanation. Any attempt at getting a reason by calling has been rebuffed in an opaque, unhelpful way. Are they correct in including benefits to calculate my gross salary? My company already deduct tax liability from me for things like Bupa
Any help would be much appreciated

I believe they work off your gross taxable income, which would include any BiK (but excludes pension contributions).Know what you don't1

Thanks for your reply, Exodi. It seems really unfair if that's the case as it's obviously not spendable income. Moreover I include my kids on my medical plan so pay for that and then a higher amount of maintenance as a result. If anyone has managed to get a rationale out of CMS, i'd love to hear. Very opaque process0

It is because it's a benefit in kind. I've had this on previous employment so while I didn't get it paid in my salary I did get taxed on it. If you are buying extra benefits they should be visible on your payslip as a deduction after tax and shouldn't be included in any CMS calculation as far as I'm aware.I’m a Forum Ambassador and I support the Forum Team on Debt Free Wannabe, Old Style Money Saving and Pensions boards. As said above gross income apart from pension.
You can appeal it, as as you say your children are included on your medical plan, not they’ll probably say there’s no need there’s NHS.0
