Implications for day-rate contractors facing an unexpected bank holiday?

    I read the government guidance as for business, who do not have to close anyway on a bank holiday.
  • I was given the jubilee bank holiday paid day off as a contractor, as I was inside IR35, and they gave it to their perm staff.

    Bank holidays have almost no meaning in employment law.

    Full time employees have a right to 28 days paid holiday a year to be taken when their employer chooses. Pro rata if part time.

    If the firm is shut on a bank holiday then the employer is simply instructing the employee to use one of their 28 days holiday on that day. Equally, they can insist the employee works on the the bank holiday.

    You may have additional contractual rights but otherwise it is a simple as that.

    In what way? The guidance was for the period of "National Mourning" & equally applies/is irrelevant  to any of those days that might be a BH since "here is no obligation on organisations to suspend business during" a bank holiday (except for a few niche exceptions)

    Now confirmed that funeral will be 11 am on Monday 19th, and confirmed before that to be a Bank Holiday. 

    I suspect I'll get it as a day off, but we might equally decide that we want to offer some kind of service to our clients. 

    I am grieving no longer getting extra days off for major Jubilees - although I am not THAT old, my birthday is close enough to the anniversary of the coronation to have had several 'extra' days' holiday over the years.

  • I'm a self-employed freelancer who currently works for one particular client Mon-Wed every week. Outside IR35 as I have several clients that I work with on a part-time basis each week/month - making up full time hours for me. I'll offer to work the bank holiday if they want me to (due to workload being quite high currently) as a normal day but I'm also happy enough to take an unpaid day off if they say they don't want me to. That's why my day rate takes getting no paid holiday into account! They will close on the bank holiday but I work remotely anyway and can do so without contant input from them, so it doesn't stop me working.

    So what you're saying is if your situation applies exactly the same as the OP's situation then he'll have an answer. If it doesn't then it was just a nice little story.

    He approved the order, its not said who proposed it. 

    If the client doesnt operate during bank holidays then its effectively agreeing out of hours working with them which they are under no obligation to agree. 

    For me this has been a very bad year with 4 days off sick (more than the last 15 years combined) and 2 extra bank holidays.

    Nonsense!

    By that argument, the government could be said to never make a decision about anything!

    All acts of parliament require the Royal Assent to become law. However in practice the Royal Assent hasn't been refused for several centuries.
