Holiday Entitlement Calculation

Options
So my work never paid me for any annual leave when I left and I've been trying to get this resolved.  I looked up the goverment calculator and it said working 37.5 hours per week over 5 days would give an annual leave allowance of 210 hours for the year. My work are claiming that should be 165 hours.

Can anyone advise if the calculation they have provided me with is valid and why there is such a huge discrepancy from the government website?

"
Based on their grade of F1 the annual leave entitlement is 154 hours per year based on 35 hours,

As the employee worked 37.5 they would have had an annual leave entitlement for the year of 165 Hours.

Holiday accrual is worked out by

165 Hours divide be 365 gives daily accrual amount (0.452), times this by number of days employed, in this case 40, holiday accrual is 18.08.

We have received anything from SAP to show increase in hours to 38.5, if this is correct then the holiday accrual should have been – 18.15

15.36 – 6th June – 9th July
2.78 - 10th July – 15th July"

You are entitled to 5.6 weeks holiday, so if you work 37.5 hours per weejk that would be 210 hours BUT  this can include bank holidays, so you need to check your ocntract / terms of employment to see what the rule is about these.

8 bank holidays would equal 60 hours which would leave 150 hours for you to take, so it's possible that the 165 figueres means that some bank holidays are counted as part of your entitlement.

It sounds as though your start point would be to check your contract to see what it says about holiday entitlment and bank holidyas, then contact your employer, and set out wht you belive the correct entitlment is.

No bank holidays, this is the only entitlement. I have advised what the government website said and this is their response.

When does your holiday year start?
If you've not done the full year, a pro rata calculation may make sense and tally with what your former employer has worked out.
Mortgage started 2020, aiming to clear 31/12/2029.

In the roundest of figures statutory holiday, for a full time employee, is (just over) one day for every two weeks worked. It should be calculated exactly, not rounded, but something in the region of two and a half days pay.
