11 year old CCJ. No Payments Missed. Creditor demanding Review

Hi. After not missing a payment on a CCJ for 11 years, the creditor's solicitor is demanding a review in order to pay it off quicker. I cannot afford to pay more and the balance is still very high. I have ADHD and find long forms difficult. They are saying that if I do not fill in a I&E form and return it by Aug 11, they will recommence action to recover the debt.
Could I just send a letter stating that my circumstances are even worse than they were and just continue to pay? What action can they take?

  • Forgot to add that it is Drydensfairfax on behalf of Arrow Global that sent the letter. They are not the original claimants.
    Please help. 
  • You will need to engage with them - they are quite within their rights to check if you can afford to pay more but equally, cannot make you pay more if you show you can't afford it. You can start by providing a doctor's note on your condition / medication and asking for more time and then do you have anyone trusted who can help you do the form?

    You are only obligated to pay the default judgement amount, basically what the court has ordered you to pay.

    An 11 year old CCJ would require Dryden's to go back to court and seek permission to further enforce the debt.
    They law assumes 6 years is time enough for this purpose, eleven years would be considered excessive, and as you have been paying it religiously, its unlikely the court would grant there proposal.

    Basically they know this, but are hoping that you do not.

    Fill the form in, if you can, to show goodwill, but make it show that any rise in payments are unaffordable.
    Your idea to write to them is also a positive step.
