Mortimer Clarke Letter - asking for formal agreement

Options
I owed some money and now I am paying it back via the courts, the money is being paid via a Consolidated Attachment of Earnings organised by the courts who received my income and expenditure forms to agree the amount to be paid every month.

Mortimer Clarke have just sent me a letter stating they are receiving payments but have no formal agreement in place. And if I do not fill in the form they sent they have 'been instructed by our client to issue an Attachment of Earnings'

I am already paying it via the courts to the amount the courts agreed. I sent Mortimer Clarke an email yesterday telling them that I already have an agreement in place with the courts and to stop sending letters for a debt that is being paid and that if they continue I will inform the courts of their letters.

Did I do the correct thing?

Yes, you did, they can`t have updated there systems to show your arrangement.

Make a complaint out of it, get some money back off them.

How would you claim for that? Usually a complaint is just returned with an apology, do you ask for monetary recompense..

I advised them I am stressed enough with the debt it have, and that they need to desist in sending the letters.

When they mess up, and send unnecessary letters etc, and you make a complaint, if it gets upheld, standard compensation is anywhere between £50-£150.

I know debt matters can be stressful, so a little light hearted win on your part may boost your confidence a little.
I`m just trying to point out that the more light hearted an approach you take, the less the stress.......with any luck anyway.

I wouldn't ask direct for money, I'd submit a formal complaint stating that you have an AOE order in place as determined by the courts and object to their harassment and threats. Then follow through the process.
Again looking at is from a positive win, their stupidity in having out of date records and toothless letter has just 'earned' you some extra money.
May you find your sister soon Helli.

Who do I submit the complaint to? Is it Mortimer Clarke or the FSA (or equivalent)

  • Thanks for everyone's help, they have agreed they should not be sending out the letters and are sending me £100 in compensation.
