Hi.
Looking for some advice. I am being pursued for a debt to CapQuest, who are using Moorcroft as the DCA.
I last made a payment on 2nd June 2014. I have only had phone contact once, where I refused to acknowledge the debt and asked them to prove it. No further communication happened until last week.
I have sent a statute barred letter I'm response (as I believe this to be the case) to both Moorcroft and Capquest and yet I am still receiving text messages from Moorcroft.
There is no evidence of debt on my credit file.
Please can you advise what to do next?
TIA

Nothing, the ball is in their court now, just because the limitation period is up, does not mean they cannot still chase the debt, because they can, what they cannot do is obtain a judgement in court against you.
You will find that once your letter filters down to the right people, collection activity may stop, if after a month or so they are still chasing this, make an official complaint to them.
You have a defence in law against this, so if it went to court you would defend it on that basis.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Thank you so much, Sourcrates. I've cleared £54,000 debt over the past 12 years ( split from ex and house repossession)....so when 'little things' like this come along after having gone through so much and thinking all is finally ok, it knocks you for six. I feel a lot better now.

You see these companies can be as verbal as they like, and send how ever many letters they can physically cram through your letterbox, non of this matters, if your certain its statute barred, and you've told them this, they cannot make you pay through the courts, and that is the acid test, all else doesn't mean a thing.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
