EBay seller claims he sent my item when the tracker doesn't agree

I ordered my item 30th June with next day delivery. I gave it 3 days and nothing arrived. I contacted the seller who asked me to give it another 2 days or if I wanted to pay them additinal money to get it reposted. I declined as I already paid for next day delivery plus tracking.

Long story short, I decided to raise a case as I asked for my monies to be returned which the seller refused telling me to wait or pay more. The seller advised he has proof of postage yet the tracker including today is still at the dispatched stage.

When I put in a case the seller then started sending threating messages saying he knows my full name and address and will come see me if I leave a bad review and mess up his ratings. I responded and reminded him that I too had his full information from company house and EBay can take approprate action as all messages can be seen.

I blocked him and reported the situation to Ebay.

My question is if the seller has proof of postage why does the tracking number which was provided only say "An update will only be provided when we attempt to deliver your item".

I still haven't recieved my item so do I assume nothing was ever posted?

    I don't think it matters as to whether or not it was posted, the seller cannot - at this stage - prove delivery. 

    You just need to escalate the case to eBay (assuming that the case has been open for the appropriate amount of time) and you'll get a refund.

    FWIW, I'm sure that I've seen that particular message on RM items that have been sent "signed for".

    Proof of postage doesn’t necessarily show online, none of mine do. However that is immaterial , as olgadapolga says keep the INR claim open as you will win if seller cannot prove delivery.

    if the threats get heavy, report them to police.

    Agree, you claim off the seller. If the item has gone missing then thats for them to sort with their courier, nothing to do with you.
    I have sold items from weeks ago that still aren't marked as delivered. The only way I know they are is because I've had positive feedback.

    Has he shown you the proof of postage?  The tracking/reference number proves they have sent a parcel with that number, but it could be anything sent to anywhere.  The PoP would show if it was sent to your address at least.

    But that is just extra background info really; all you need to do is follow through with the case.
