Living in a buy to Let

Am in the process of divorce and Stbx wants to buy me out and stay in BTL ( lender is unaware that we have been living there ). When I called with a "general enquiry" about this they didn't seem at all concerned about this and stated that they would only take action if they found out themselves not if they were alerted to it. Him being allowed to remain in the property has implications for child arrangements so I really don't want this.
How can I get the lender to take this seriously..... hoping for house sale rather an order for him to keep it.
