Hey I have been at my new job for 2 months and on Saturday had to phone in sick I had 2 days prior to this as days off but manged to catch dv from family I work in the health sector and couldn’t go in I’m nervous I’m going to get fired as I’m not back now intill Thursday I have a autoimmune disease so can’t actually help being I’ll

    "Probation" has very little meaning in employment law apart from maybe granting you some additional contractual rights when it is "passed". There is no protection against unfair dismissal (except for certain forms of unlawful discrimination etc) for two years so, in a way, everybody is on "probation" until then!

    It would be a very unusual employer who dismissed for one genuine sickness absence.

    If your autoimmune disease amounts to a disability (??) for employment law purposes and the employer is formally aware, then you are entitled to "reasonable adjustments" which might include some relaxation of the normal sickness policy.

    Presumably your health condition was declared at the time you accepted your employment, which will have alerted your employer to the fact you may be more vulnerable than others to being ill - but actually nobody can help being ill!
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!  
  • Try not to worry.  I was let go 5 weeks into a new job as couldn't carry on in pain but the Employer couldn't handle anyone else off - they had paternity going on (which probably secretly was why I was hired to start with) and someone quit the previous week with no notice. I worked for someone hard and straight talking in a small business with no HR, not everyone can have this luck I promise. 

    Either way, all worked out in the end, couple of days later I have now a 12 month role as opposed to knowing my original job highly likely would have finished after the summer. 

    Worst things worse : Things do happen for a reason.

    As you work in the health sector, I hope you have had training in hygiene procedures which should mean you normally avoid getting D&V.  I don't think having an autoimmune disease means you are more likely to catch D&V.

    In the circumstances your employer should actually be pleased that you are not going into work where you could pass this on.

    I'm not sure if you mean you've had 2 occasions off sick prior to Saturday or now 3. As far as I remember you will hit a trigger if you have 3 absences in a rolling 12 months, which could end up with you out off a job. It doesn't matter even if you've an operation and you informed your bosses with proof you will still hit a trigger. As you have only worked for 2 months its more than likely you will be let go.
    Your manager will ask you to attend a meeting when you return back to work, if its a formal one then yeah best look for another job as you won't be able to prove your not going to be off sick again within the next 10 months. It's harsh, but they have the rules in place for a reason.
    I was off work on 1 occasion over the past 9 months as I was throwing up in work and they sent me home. I still hit a trigger and was asked to an informal meeting.

    I think you'll find the majority of people can't help getting ill... not many people's hobbies including going to the infectious diseases ward of their local hospital and licking all the patients.

    Under 2 years service you can be dismissed without having to have a reason for doing so. Probation really has little meaning and is often more about a step change in your notice period or such after you've passed.

    Does your disease fall under the definition of a disability? If so, did you make your employers aware of your disability and what reasonable adjustments would be needed for it? 

    Most companies use something like the Bradford factor ( incidents of sickness ^2 x total days off) and so if the two previous days off were consecutive (score 12) or separate (score 27) will make a notable difference to how its viewed.
