Let down by AXA who didn't represent us in court

I'm going to end up gluing myself to AXA head offices at this rate. I don't get many days off so to spend a whole one, especially a sunny one, on hold has thoroughly upset me.

is it just me or does the OPs version differ quite a bit from the claim - the bit about overtaking rather than as a result of a three point turn are quite different things - could two separate incidents have got mixed up?1

Its not really that different... Compared to some claims the two version events have some overlap even if the reason why the OP turned across the path is different (turn into side road -v- 3 point turn)2 -
Yes, they are claiming they drove into my husband as he went to do a three point turn, whereas he went to turn right into a side street. It happened on a residential estate with lots of parked cars around. The other person went to overtake him as he went to turn (in order to travel straight ahead). He'd dropped my mum off just up the same street and was pulling away as she turned into the road quite fast from around a corner. Presumably he wasn't driving fast enough for her liking as she was driving very close behind him, flashing and beeping, before she went to overtake. Very abusive and much screaming about her dashcam footage, which was never provided to AXA.
It was AXA who decided to contest her claim, not us, we just passed everything over to them - it doesn't really matter if we feel she was at fault or not. I presume from the evidence provided and nature of damage to our car that they decided not to accept fault.
She posted untrue comments on social media afterwards but I can't prove that and doubt court would care even if I could. I did try contacting AXA on Facebook but my post disappeared!0 -

Don't think it really matters anymore, the case was heard in court and awarded to the claimant as nobody countered the story offered. Wasn't heard in court, if no defence is filed its automatically awarded, similarly if a defence is submitted but no one turns up to court... no point doing anything other than awarding and moving onto the next one.tightauldgit said:

Have to remember that in English law the Judge is there to decide based on the evidence presented by the parties... they do not have investigative powers like they do under Roman law0
