Hi everyone.
Im after some help. This may have been dealt with before but havent got time to trawl through previous posts today, sorry!
I've had a notice today from the city council re council tax. It says we owe £160 from 2001 under a liability order. This was a previous address. We are sure that we owed nothing. We gave the council our new address when we moved. We did sell the house jan 2002 but the house had been empty for 5 months prevous to the sale and we had paid council tax in our new home. The council knew the poperty was empty and had granted us some excemption.
We have thrown away all bills and documents re 2001 in the old property as being over 6 years ago.
Can they do this?
How can we prove we dont owe them anything?

You need to ask them to break down the charge and give you information regarding when the Class C exemption was granted - if the Class C was given for the 5 months then the debt must be from before that date.
If you query it then they should hold further recovery whilst they deal with your query as a matter of good practice.
Did you by any chance pay by Direct Debit ?I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
