Solar panel lease not signed


We have leased the roof space for
solar panels. The solar panel company has since changed hands. We have a new
lease but it's not signed or dated.
We are in the process of selling our home; everything is in place except the
signed and dated lease that the buyers solicitors require.
We are having difficulties tracing the company "Renewable Clean Energy 3
ltd". we have their address through Companies House Website
We also clicked the "People Tab", and one of the names that came up
was AVIVA COMPANY SECRETARIAL SERVICES LIMITED (same address) We
manage to contact AVIVA and had some help. The
receptionist enquired for us and came up with another name
"Ecovision" which fairplay to her, she enquired on our behalf but
came up negative, no registration. I've contacted ofgem and now awaiting a
further response from them. My question is "Has anyone else had or is
having this problem with Solar panel leases?

The FIT Register should provide you with the name of the solar FIT beneficiary.
Your solicitor should also be able to advise whether indemnity insurance might be a way forward.

Funny thing is we asked about providing Indemnity for the roof space lease when we had to ask for a copy of an access rights indemnity from the company that provided the cover.
They said we should ask our solicitor about this roof space indemnity and when we did ask the solicitors the question they said:
Quote "Most solar panel indemnities are for defective leases but not for the non-registration of a lease, but it is something we can explore if the buyer is agreeable. As soon as we know from the buyers solicitor what their position is we can take it from there.
We are going to look into this and I'll get back to you when we hear anything. Cheers John

I was wandering that if a solar panel company (the tenant) has not visited a landlords property (where solar panels were installed). Had been absent for over 2 years to inspect, to carry out any maintenance or any possible repairs to the equipment, that they (the solar panel company (tenent)) is in breach of there obligations and that their absence would affect the roof space lease agreement?

The Lease set out in clause (LR1).
9. Further Rights.
9.1 The Premises are let together with the following rights for the Tenants benefit:
9.1.1 To install, maintain (which shall include the taking of meter reading etc, repair, alter, replace, remove etc, etc. at the end says and to carry out associated works;
9.1.2 to use means of access in, etc, etc, and at the end says "in order to exercise the rights granted and comply with its obligations under this Lease;
9.1.3 to connect to etc, etc;
9.1.4 the right for support fot PV system, etc, etc;
9.1.5 all the rights granted in deeds referred to in the tile number specified at Clause LR.2.1 of the land registry particulars of this Lease.0 -
May I add we've sent 2 registerded letters to two different addresses, one address was from the unsigned lease.
Below are rough extracts.
1st letter Dated 12/1/2022 - Title No. xxxxxxxxLease relating to airspace above roof of xxx xxx xxxxxDear Sir/Madam, we believe you took over from X Solar Solutions.We’ve not heard from you since a representative of X visited us some years ago.The solar power equipment may have developed a faultCan you visit us to check your equipment etc, etc,, please?
The 2nd address from Companies House website.2nd letter Dated 8/06/2022Lease relating to airspace etc,etc.Dear XWe are selling X home and we're requesting a copy of thesolar panels lease for our solicitors, signed and date from you assoon as possible please. Regards. XX
We are waiting for information who owns the panels an their contact detail from Central FIT Register I don't know how long this will take.0 -
There is a possibility that we now own the solar panels as they weren't registered with the FIT Scheme or on the
Land Registry. As I also understand the FIT registar has closed and it has been replaced by another
”system”...
