    Unprecedented surely that’s why the time scale is in place all information exchanged in a time scale it’s hard enough getting information which is valid from them in their time restrictions

    By unprecedented I meant that there probably has not been a precedent set in a case where the VOA was late in their submission of their evidence, i.e. it's probably never happened before. In the old days (before taxpayers were required to submit their evidence prior to the hearing and the VOA only had to submit evidence of sales) if the VOA were late (and I don't remember there ever being such an occurrence) either an adjournment would have been sought or the the VOA would have defended the case on settlement evidence (which often outweighed sales evidence)


    2 or 3 months ago, I asked the VT what would happen if the VOA were late in submitting their evidence and received a very non-committal reply

    I asked what would happen if the VOA didn't submit their evidence on time and the reply was the Tribunal would need to be informed of this and the matter would be raised as a preliminary issue at the hearing. 


    So I do not know whether the late submission would be allowed or whether the hearing would have to be adjourned or whether the hearing would have to proceed without VT evidence.
