  • Well I think that because you are being honest and saying that you honestly can't remember , it more than likely means that you didn't say anything at all.That would be my reasoning, but yes as ohreally says, it's definately not the right way to answer, especially in front of the investigators. It should be much easier to defend yourself full in the knowledge of who has said this and when, and where. But be careful, they will often ask you up front if you said it first, rather than go into the details. Well , my company did to me in my disciplinary. Good luck with this- you have a lot of good advice here, and hopefully this will help you out and get this sorted.

    Thanks. Only said that because I cant bear the though of someone accusing me of something that i havent done which makes me doubt my own mind. To my knowledge i NEVER discuss anyones personal records, i NEVER discuss or tell other people why they are off or for how long. I pride myself on the fact people can trust me and confide in me knowing i would not pass it on to anyone else. I've been in this type of role long enough to know this is unacceptable and therefore do not behave in this way.

    What a crap position to be in a week till christmas. I think you should start looking for work elsewhere, or atleast get your CV sorted so when the agencies and companies start recruiting for new year your ready to go. Its worth sticking the job in case its just a big misunderstanding and the fact you love your job is a real bonus you dont want to lose but have the job applications in the pipeline so if they say !!!!!! off you have a head start.

    By the way HUGS :kisses3: things will work out okay. What will be will be......... (-:

    Quick update. I got called into the office as i was leaving tonight to be told that i am having a disciplinary hearing tomorrow at 11 and that i can bring someone with me if i want to.
    HR said they are going to email details of what is to be discussed tomorrow to my home email address tonight. So far i've received nothing.

    Really scared now. Still have no clue what i've done.

    It can't be a disciplinary hearing as they have not told you what you have done wrong! It can only be a prelim meeting prior to a disciplinary.
    Make sure you take someone in with you; check your spam just in case the email doesn't get to you, and read that ACAS guidance; print it out if you can. I don't think emailing you in the evening is enough time for you to consider the allegations.

    Did you ask tonight when you were called in what it was about? What did they say? Did you ask why nobody will tell you what you were supposed to have done?

    Make sure that the person that goes in with you takes notes. I mean about everything, start time, location, what was said by whom in what order.
    If they put something to you that you are supposed to have done, state that you have not had time to consider the allegation, and ask for 24/48 hours absorb the information.
    Ask for a copy of their disciplinary procedures prior to the meeting; if they have a HR dept they must have these. Thus far, they have not followed the ACAS guidance and this is leaving you without the ability to make a defence. For goodness sake, they haven't even actually told you what you are supposed to have done.

    I hope all goes well, if it gets too hairy, ask for an adjournment. Keep it factual and don't get into any 'she said, he said' arguments. Make sure you recap; and keep a cool head.


    That's all you can do at the moment. If you did say something and it has been taken out of context, then you will obviously be shocked and offer to apologise immediately, in writing or face to face whatever the person wants.

    they did check with me that tomorrow was ok and i said yes because i just want it over and done with. If i dont have the hearing tomorrow it wont be until next year.
    Apparently the email they are sending me will detail what has been said etc.

    I have been given a copy of the disciplinary procedure and have read through it.

    In that case, I hope that the email comes so that you can prepare. If it doesn't, ask for them to print a copy for you first thing tomorrow so that you know what you are walking into.
  • This really is an unusual situation.

    Under current law, they can not hold a final disciplinary hearing (in which one of the outcomes may be your dismissal) without first telling you what your accused of. Therefore, unless they're ignoring the law, the meeting must either be an investigation type meeting or they don't intend to dismiss or demote you.

    My advice would be to listen to what they've got to say and be very careful about how you respond. IMO it's unfair of them to put you on the spot and demand instant responses. If they give you any information, perhaps a record of time spent on you computer, a statement from another employee, etc... ask for a break in the meeting to consider what's in the document. Don't give any 'snap' answers you might regret later.

    Take someone with you, a college, if possible. They may refuse your request to take someone outside the business If there's someone you what to take with you to the meeting who can't attend tomorrow, consider asking for the meeting to be re-arranged.

    Well. i finally got the statements last night at about 8.30. Copies of everyone on my teams interviews. It read like a slagging off from hell. Blatant retaliation from being pulled up when they've done something wrong. Not relevant but extemely upsetting to read.
    The main point of them all which was mentioned in 2 interviews was that i had discussed a members sickness. It was agreed in the hearing that this person had previously told everyone what the problem was but as a supervisor i am not meant to be party to these discussions and therefore have breached some rule.

    It also came to light that my tone when putting my point across, even if it is the fifth time i've told someone something and that argue that its not fair, is not professional. Therefore all of my team find me unapproachable and untrustworthy. I gave evidence (and lots of it) that every member of team has approached about at least 1 thing in the last 2 weeks and some of this confidential that does coincide with me being these things but it was not accepted as a decent argument. I was told that they probably came to me because they had nobody else to go to. ?? I must point out however that 3 people said i was over friendly in the line before this..... and all of them said was a great supervisor i was and how much i have improved the team.

    The hearing took 3 hours and i am mentally and emotionally exhausted.
    Outcome. a written warning that stays on my record for 12 months and i will be placed on a performance improvement plan in the new year.


    I am going to keep my head down. Do nothing outside my job spec for the team and not get involved in any type of conversation that is not work related. They will not be given any type of leniency towards holidays without notice or leaving early for hairdressers. I will do everything by the book from now on.

    Seems like sour grapes started something off, and by the time they realised there was nothing there; they had to get you for something. Sounds like a load of cods to me; I can't understand why you are on a performance improvement plan if it is an issue around breaking a rule. Anyhow...

    i know you just want to forget it now, but I would recommend that you get all this in writing from them that states what you actually did; and show it to someone who knows about these things for an opinion. You also have those statements, I would get them looked at. You do have the right of appeal, this should be in the letter. I would consider it; after taking professional advice.

    Just learn from it, and make sure you aren't too chummy in future; unfortunately you don't get any favours being too friendly, even if that is your nature, when you are managing people.

    Also, if they have a problem with your approach, you need to keep asking 'in what context'. It's really not enough to say that you are not professional enough, you need concrete examples to improve yourself.
