1. The NOW and Capital & Capital XTRA May  promotion (‘Promotion’) is organised by Global (as defined in the General Terms and Conditions). The Promotion will run from Thursday 9th June 2022 to Sunday 10th July 2022 on Capital Network. Global is the Promoter.

3. To enter the Promotion, you must go online to the Promotion entry page at Capitalfm.com/win or Capitalxtra.com/win, register your details and submit your three top picks of NOW shows provided.  

4. Online entry will open at 10:00 on Thursday 9th June 2022 and close at 23:59 on Sunday 10th  July 2022 Entries received before or after this time will not be included in the Promotion. 

5.  Within 28 days of the closing time of the Promotion, all eligible entries will be entered into a draw. One correct entry will be selected at random and the winning entrant will be contacted by one of our representatives via telephone on the telephone number on which you entered. If such winner does not respond within 28 days from being contacted, they will forfeit their right to the prize and we shall be entitled to select another winner by another random draw. That subsequent winner must respond to the notification email within 14 days of the date on which they are notified, or they will also forfeit the prize.  

6. We and the prize provider may publish and publicise name, image, social media handle and/or profile picture, your nearest geographical location (for example, your nearest city, town or county) and your entry, and we may refer to your association with the Promotion and/or the prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Promotion.

Option 1 Terms: 

A. Travel is subject to availability at the discretion of NDL Travel and excludes bank holidays, Valentine’s day/weekend and school holiday periods, specifically the Christmas holidays, summer holidays, spring and autumn half terms and Easter in the UK. 

B. Your prize includes off peak train travel that will need to be booked with us at least 6 weeks before you plan to travel. Off peak refers to travel booked outside of morning and evening commuter periods, this varies depending on the train operator but generally excludes departures between 0600-1000 and 1600-1900. 

C. Transfers will be private and not shared with other passengers. 

D. You will be staying in a 4* hotel, sharing a double room with en-suite bathroom on a bed and breakfast basis. If you’d prefer a twin room, we will do what we can to secure this for you, but it cannot be guaranteed. 

E. Thames speedboat experience will last the duration of approx. 80 minutes. This experience is not private and may be shared with other members of the public. Weight and height restrictions may apply.  

F. White watersports will be winner’s choice from the following: rafting unleashed, legacy rafting, hydrospeeding, rodeo rafting or hot dogs (duo ride). The activity will last approx. 90 minutes. Height and weight restrictions may apply. Participants must be able to swim.  

G. Your dinner at the Treehouse is based on 2 adults enjoying a three-course meal from the a la carte menu including 3 cocktails each.  All restaurant reservations are subject to availability at the time of booking.  

H. Spending money will be transferred directly to the winner upon confirmation of full and correct bank details. Transfers can take up to 5 working days.

Option 2 Terms:

B. Prize includes return economy flights, all flight taxes and surcharges as well as one piece of checked baggage per two people. Subject to availability, departure airport used will be the winners nearest international airport that operates direct flights to Switzerland. Please note, this may not be your closest airport. If you don’t hold a UK passport you may need a visa for this destination, and this should be arranged with the appropriate embassy. Although please note the cost of a visa of this kind isn’t included in your prize. 

C. Due to the current ongoing situation with travel advice in relation to Covid-19, we would advise that you look at all the information available with regards to quarantine, vaccination, and testing requirements of the destination you are travelling to, before selecting your dates. F. Canyon Swing experience will last approx. 3 hours. This activity is seasonal from April until November. Minimum age is 14 years and the maximum weight allowed is 120kg (265lbs). Subject to availability. 

G. Travel insurance is subject to normal terms of acceptance.  Pre-existing medical conditions may not be covered.  No age restrictions apply. 

H. All prizes must be claimed and booked by the prize winner within 12 months from the date of our initial correspondence with them.

18.     NOW reserves the right to refuse or withdraw the Prize if a winner or a party authorised by the winner to act on their behalf, threatens or abuses a Staff employee or otherwise conducts themselves in a manner that NOW reasonably regards as inappropriate, offensive or unlawful. 

Rooftop Film Club prize terms: 

27.      Winner will receive a pair of standard Lounge Seat tickets for a screening of their choice at either Rooftop Film Club Venue (Bussey Building, Peckham/Roof East Stratford) and are subject to availability. Screening details can be found at https://rooftopfilmclub.com/london/ and are released monthly. 

28.      Tickets are valid until 18 September 2022. 

29.     Tickets are non-transferrable and non-refundable. No cash alternative is available. Any tickets suspected of being purchased for the sole purpose of reselling can be cancelled at the discretion of Rooftop Film Club. 

30.       Valid ID may be required on entry to our Rooftop Film Club venues (18+). 

31.      The venue reserves the right to refuse admission and may on occasion have to conduct security searches to ensure the safety of guests. 

32.       Venues are not BYO - please don’t bring in food or drink. 

33.       Please arrive on time as tardy guests cannot always be guaranteed entry. 

34.      Screenings will go ahead in all reasonable weather conditions, however in the event of cancellation due to adverse weather conditions ticket holders will be notified at least 3 hours prior to the event. If the weather is deemed dangerous, Rooftop Film Club reserves the right to cancel the event and reschedule it to a new date for which all tickets will be transferred. Where a rescheduled date is not available, all tickets from the original cancelled booking will be valid for another screening of the ticket holder's choice, subject to availability. 

35.     This element of the prize is separately organised and will be fulfilled by prize fulfilment agency The Promotions Factory on behalf of NOW. Winners must contact prize provider with three preferred screening dates, no later than one week prior to event. Tickets will be allocated subject to availability. 

37.  The prize excludes meals and drinks (except where stated above), travel and accommodation and anything not expressly included in the prize. 

Other prize terms: 

38.      You must, at your own cost, comply with all necessary checks, and/or tests required for travelling to and from and entering and exiting your travel destination/venue. This includes, but is not limited to, purchasing, organising, undertaking, recording and/or registering any required Covid-19 tests. We will not be responsible for any costs incurred by you in complying with this clause, nor will we purchase, organise, undertake, record and/or register any required Covid-19 tests.  

39.     You must comply with all applicable rules, regulations and guidance relating to Covid-19, both in the UK and your travel destination/venue. We are not responsible for your failure to comply with such rules, regulations and guidance.  

40.      You acknowledge and agree that, without limitation to the provisions of Clause 12 of the General Terms & Conditions, our ability to fulfil a prize and/or perform any of our obligations under the Promotion Terms and Conditions could be affected by an actual or threatened epidemic, pandemic, disease or quarantine and/or any corresponding governmental action, guidance and/or ruling (including but not limited to any Foreign, Commonwealth & Development Office guidance) (collectively ‘Covid Measures’).   

41.       If due to any Covid Measures, we are unable to fulfil a prize or perform any of our other obligations under the Promotion Terms and Conditions, then we shall not be in breach of the Promotion Terms and Conditions.  In accordance with Clause 16 below, in these circumstances, we reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion. 

42.       Any other costs and expenses which are not specifically included in the prize description are excluded and will be the sole responsibility of the winner. By way of example, without limitation. 

43.       The prize is non-transferable and non-refundable. 

44.       We reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion.

Data Protection: 

46.     Your personal data that you provide to us will be collected and processed by us, our licensees (including Communicorp UK Limited) as well as the prize providers, and if applicable, our service providers, network operators and suppliers in order to administer and fulfil the Promotion. Your personal data may also be disclosed to the Phone-paid Services Authority, Ofcom and/or the Advertising Standards Authority at their reasonable request for regulatory purposes, for example, in order to prevent, investigate and detect crime, fraud or anti-social behaviour and comply with law enforcement agencies and applicable advertising codes. 

47.       By entering a Promotion, you acknowledge that any personal data provided by you in connection with the Promotion will be processed as set out above and in accordance with our Privacy Policy which sets out full details of how we process personal data and how you can exercise your rights as a data subject. Please ensure you have read and understood our Privacy before entering any Promotion. If you are required to submit a guest(s)/travel companion(s) personal data to enter a Promotion, you must ensure that your guest(s)/travel companion(s) have given you consent to provide us their personal data. 

48.    You may be asked if you want to opt-in to marketing from us when you enter a Promotion. If you choose to opt-in, we will use your personal data for marketing purposes (see Global's  Privacy Policy for more details). You can withdraw your consent to marketing at any time by unsubscribing.  

49.      We and the prize providers may transfer and process personal data outside of the EEA and UK for the purposes of administering the Promotion. Where any transfers are made outside of the EEA or UK we will ensure appropriate safeguards to protect your personal data are in place.  

50.      We will hold your personal data for a period of up to 3 years in order to comply with our regulatory obligations. 

51.   You may request the removal of your personal details from our database by contacting privacy@global.com. If you request that your personal details be removed prior to the conclusion of a Promotion, you will forfeit your right to enter the Promotion and/or claim any prize and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable.
