Stamp Duty.

Hi All.

I am currently named on the mortgage for my family home with my mother who resides at the property. 

My new wife and I are looking to purchase our own house now (we are currently renting). My wife is a first time buyer but I know that is not a factor.  

Would I need to pay second home stamp duty? The new property will be my main home as the family home is my mothers main home. As I said my mother is named on the mortgage for the family home.

I appreciate that this is a weird situation. But any knowledge would be appreciated.

Are you on the deeds for the family home, or just the mortgage?

I believe I am on the deeds along with my mother. She lives at the property. It’s her main residence. My main residence would be the new property.

No obvious wiggle room there then, so the additional SDLT will apply unless you can show that you do not have a beneficial interest..?

Edit: ... or a right to occupy, forgot that bit...
