How should an employer be calculating uniform allowance level for NMW staff?

    How long has she worked there? and does she want to stay there? 

    Raising a grievance at an early stage in a job may raise a red flag. Since there is very little job security in the first two years, being seen as a troublemaker may not be the wisest move.

    But what does SHE want to do? That's the key question.

    Theoretically of course there is no two year qualifying period to be able to claim unfair dismissal if she were to be dismissed for asserting a statutory right.

    Oh, she's been there over 3 years now, but yes we are worried about that; especially as she's just had to raise a grievance about another issue, and the attitude of the head of HR just for trying to be treated properly was very poor (thankfully she was just taking notes, and the CEO actually hosting the meeting was great).
    I gather the HMRC line can be pretty slow to get to it, but indeed might be the more favourable option.
