Employer refusing to send SSP1

Looking for any advice, as I'm struggling to get any support/assistance to help me in my current situation. 

Been signed off for over 12 mths. My SSP ended on 1st March. I've sent off claims for ESA & PIP early march, who are asking for a SSP1.  My employers have stated twice, they cannot provide this.   I am still employed currently, started a sabbatical on 1st March, obviously unpaid. 

My last pay was 20/2, am falling behind on bills. 

Is the above correct?.  Are claims backdated?.

    If you can't get form SSP1 or a written statement from your employer, contact HMRC's employees' enquiry line on 0300 200 3500.They'll ask your employer why they think you're not entitled to SSP. You'll need to have this information ready when you to talk to HMRC: your name, address and national insurance number
  • Obviously I was entitled to SSP, which I was receiving, it just happened to come to an end on 1st march. 

    Issue is my employers won't issue the form stating that I no longer am entitled to SSP. 

    So currently my benefit claims are on hold, which as I understand are not backdated, so effectively my employers are costing me money!!!.

    Has your employer told you why they can't/won't issue an SSP1 form?

    If not, have you asked them?

    Is it because you are on sabbatical, or have you exhausted it (28 weeks)?

    Mmm, yes I've tried, I did find this info myself online!. Over an hour and a half, trying to get through. Hence why I posted on here.

    Mmm, yes I've tried, I did find this info myself online!. Over an hour and a half, trying to get through. Hence why I posted on here.   
    Well in that case you are out of options. You either need something from the employer - and that doesn't seem to be working out - or you need HMRC to intervene with the employer. Perhaps you should speak to Citizens Advice?

    By the way - You say that you have been signed off for over 12 months - so why has your SSP only just run out in March this year because it is only paid for 28 weeks, isn't it? You also don't need the SSP1 to claim PIP - whether you are in work or whether you have an income has no relevance to the PIP assessment, so that claim cannot be held up by the lack of an SSP1.

    Just got hold of HMRC, all sorted. Form is on its way.  App my employer should have actioned this!!. 

    My sick pay is 12 mths, always has been since I started in 1989. Old contract, I know new starters get the 28 weeks.

    That would be company sick pay which is a contractual matter. SSP (the cost of which these days is met by the company not the government despite the name) is limited to 28 weeks.

    ^^^^ This

    The first 28 weeks of your Company sick pay generally includes the SSP element - mine is the same. So technically your SSP ran out a long time ago.
