Extra bank holidays

Hello,

For those of you who work part-time or work on bank holidays, make sure that your employer has updated this year the number of bank holidays to 9. So, if your contract says that you have X number of holidays + bank holidays, you are due ONE extra day this year. My employer hasn't done the change yet so make sure you do not lose that day.

Great if the employer has been stupid enough to write the holiday entitlement as " X number of days plus bank holidays".  However if they have "including bank holidays", the extra BH this year (and possibly future years) simply means potentially one fewer as a choice to be agreed with the employer.

General_Grant is correct. However, for those whose employers don't say X days plus bank holidays, it is also worth checking what custom and practice dictates. I asked the question where I work, and was able to tell them what we did last time there was an extra BH - we had an extra day's BH entitlement.

Of course, just because we were given an extra day last time doesn't mean they HAVE to give you an extra day this time. But if your HR managers are not sure what to do, then reminding them of C&P may be useful (if it's in your favour of course!)

Why is it "stupid" of them to write it like that? My employer writes it like that because it's one of the perks that bank holidays don't come out your holiday allowance.

Because it would tie their hands into paying for an additional day (or more) holiday in any year when the government decides to have additional bank holidays.

By default there is no legal right to paid leave on bank holidays. The minimum legal entitlement (for full time employees) is to 5.6 weeks (28 days) holiday per year to be taken when the employer decides. Anything beyond that is a contractual matter.

Yes i understand what your saying but like i said one of the perks of my workplace is to have all bank holidays off with fully pay (they official close every bank holiday). So it was very much intentional that they wrote it as annual leave + bank holidays in the contract and to basically say every empoyer who writes it like this is "stupid" doesn't make sense.

Even without writing "plus", if the workplace closes on bank holidays and includes them in the entitlement, the holidays will be fully paid.  It isn't a particular perk to have bank holidays off.

Those employers who use the "plus" phrase don't necessarily mean it as extra above the legal entitlement but they are leaving themselves open to whims of the Government deciding on national celebrations.  Most employment contracts I have seen which include the phrase have grown out of versions of a document from decades earlier without thinking of the implications..  It is my opinion that doing so is less than intelligent.

Unless they're offering you stat min plus BH (which seems unlikely)
    ie 28 Days plus BH

    What's the difference between saying
20 Days leave plus 8 BH vs 28 Days including BH?

ETA Don't Scotland & N Ireland get an extra BH over England & Wales?

New starters get 28 days plus bank holidays and then and extra day for every 5 years of service up to a maximum of 5 extra.

So i see it as 28+ days you get to choose when you have off and then the bank holidays are an extra bonus but you can't choose.

If they said a set number of days including bank holidays then i can forsee complaints from people where they have to use a day of their holiday for a bank holiday and people will want to come in and work instead so the site can't be completely closed.

As above it's basically extra days each year that we get off so i think of it as a perk personally.

If the wording was '20 days plus 8 bank holidays' then it would be no differnt - either way you get a total of 28 days, and if they close on the extra bank holiday they can equire you to use one of your 20 days on that date. So you get 19 says you can take when you want and 9 days you have yto use when the employer tells you to.
However, If it says '20 days plus bank holidays'  (which is a more common wording, where the contract is framed that way) then there is a difference, as this year, that would mean that you got 29 days instead of 28. Which benefits you and puts more cost on the employer.

I don't think it is necessarily stupid, as General Grant suggests - it's entirely possible that employers take the view that while it does mean that they are subject to the governments choices to add extra holidays it 's a realtively small issue in the grand scheme of things -
