Employer's failure to submit pension contribution

Hello,

My daughter works for a hair salon, she and several of her colleagues have found their employer has failed to forward their pension contribution to the pension company. Neither have they submitted there own contributions for at least the last ten months or more. Enquiries with the Pensions Regulator showed little interest. What can they do, who can they approach.

    Has this been raised with the employer yet? You need to give them a chance to sort it out before getting the Pensions Regulator involved. It could be something as simple as the payments were made but with an incorrect reference number so the money is sitting in a suspense account waiting to be allocated.

    My employer hasn’t passed my contributions to my pension scheme. When should they do this by?

    Contributions deducted from your pay must be paid to the scheme by the 22nd of the following month (if paid electronically) or by the 19th of the following month in any other case.

    If this has not happened, you should first raise this with your employer and give them the chance to put things right. 
     
    If you are unhappy with their response or remain dissatisfied please submit a completed application to us along with relevant paperwork and supporting documents.

  • This has been raised with the employer on numerous occasions by several different staff members only to be given various reasons why there is a delay, none the same and certainly none that make any sense. This has been going on for at least ten months. I think they has had sufficient time to rectify this error!!

    It sounds like you, or more likely your daughter, should submit a complaint starting by following the link in eskbanker's post. Ask for more advice if you have any trouble filling in the forms or submitting evidence.

    Please try to collect as accurate records as possible of your conversations/correspondence with your employers as possible.

    An employer not paying pension contributions is usually a sign that they are in financial difficulties. The OP's daughter should start looking for a new job.

    My daughter is in the process of submitting the complaint form and yes nigel she has left that employer and now works for a company that appreciates their staff.

    Not paying into the pension with the employer's contributions is a breach.   Not paying the employee contributions is theft (once it becomes clear it is not a short term clerical error).

    Theft? I’d imagine that’s a matter for the police if theft is still a crime. Or are businesses spared that indignity?
