hi my dad was a victim of identity theft in 2002 for 900 pounds on a credit card . My dad told halifax there was no credit card. My dad is disabled and dislexc .Halifax told my the account. Was closed nothing was mentioned for 20 yrs then this year capquest sent him a letter saying he owes 8324 pound Halifax refuse to except crime ref numbers and told my dad they sold it as debt to capquest . We have been in touch with cab and police can any one help please as i am concerned about my dads health thanks

Hi, you say that you have been in touch with CAB (now Citizens Advice) - what have they advised?
Does the letter from Capquest contain full details of the debt - where it originated, how it has accrued, etc? If Halifax sold the debt to Capquest then Capquest are the ones you should contact and they are the ones you should give the crime reference numbers, etc. to. But before doing that I'd contact StepChange (a free debt help agency - I have used them in the past and can recommend them highly) may be able to help, as per the information from them in the following link -

You need to ask the admin here to put this on the debt-free forum, not bankruptcy.
Assuming dad is in England or Wales, a debt that has not been acknowledged in writing or had a payment made towards it for 6 years is statute barred. Which means that the creditor can ask nicely but it not entitled to any money.
Even if they got a CCJ, 6 years after that was granted they'd have to get court permission to pursue the matter. So you're well over the 12 year limit.
In Scotland the time limit for action is 5 years and the rules stricter.
Please speak to stepchange or national debtline, both of which offer free advice. They can probably send you a format letter (or a link to one) which you can send telling capquest were to go.

Don`t panic, Capquest love to try their luck, its almost laughable trying to collect a 20 year old fraudulent debt, they already know dam well is statute barred.
The hybrid letter would be best, "we do not acknowledge any debt to Capquest, but if such a debt existed it would now be statute barred".
