Good question - I had to go look that up. And no, they can't do that. Here's the link for you - https://www.acas.org.uk/checking-holiday-entitlement/calculating-holiday-pay Average pay is now calculated over 52 weeks not 12 (and I did not know that - it isn't something I ever deal with at work) and if you have weeks unpaid or SSP during that period they have to take an earlier "normal" week.1
