  • I will create another thread, I have a letter from the 2nd January 2022 from DCB Legal 

    Letter of Claim

    It is with 2 pcns in 2019 - Again from UKPC Limited

    They said Amount due £340  

    So now DCB Legal are pursuing separate claims, shall I mention this in court once I get my Hearing date? 

    So as it stands I have 1 court claim form which I am awaiting a hearing date for, the claimant is UKPC Limited and DCB Legal Ltd are pursuing.

    I only recall receiving the initial fine. Then a threatening letter from DCBL which we ignored. I do not recall ever seeing anything relating to an actual CCJ except DCBL threatening me with escalation. 
    The first I found out about CCJ's was November last year when I was trying to remortgage and was refused. I registered through MSE to see Experian record which showed the CCJ, I then registered fully with clear score, then I could see that 3 CCJ's are now on my account.
    Whether it would work as an excuse, we have had mail delivered to wrong addresses here as my front door sits on a different road to what my address says so I know some mail has gone missing.
    Just wondering how I can proceed to clear these CCJ's now,

    @Coupon-mad , in your opinion do you think it is worthwhile me proceeding in this manner, IE SAR? Or, would you consider this an issue I need to resolve with the claimant?

    I have no idea how they have managed to issue 3 CCJ's, would I ring county court business centre to find out more information as I have not received any letters stating that I need to respond to a CCJ. I found out when I tried to remortgage. I am really struggling with understanding the best way to proceed to rectify this situation, if I have to pay, so be it. If it's worth fighting, I will.

    I'd firstly ring the CCBC and ask for a copy of all three Particulars of Claim, date of filing each one, plus in each case - and this is vital to know - which (exact) address was used for you, plus who was the Claimant and the name and address of their legal representative from the claims.

    Ask them to email that information so you have it for evidential value.

    I wonder if they used an old address for you.

    You need to sort out with your local sorting office and/or the postie, the issues with your mail not being delivered.

    @Coupon-mad I have spoken CCBC and taken down the details of the CCJ's. Appears to be 3 PCN, so 3 CCJs with different references.  Though we only knew of 2.
    All issued by One Parking Solutions. 2 are being handled by DCBL and 1 by Gladstone's Solicitors. I have references and incident dates etc. They wouldn't send them to be my email but did say particulars can be sent on for a fee. I'm worried about spending anything at the moment with these fines sitting over me and worried about debt collectors appearing on my door step.
    Total of all CCJs is just under £900 😭.
    My wife got the tickets and wanted to ignore PCNs she now wants to phone them to sort it which will not benefit anyone now as the car is my name and my responsibility. I understand if I pay the CCJ will be "satisfied" is that the best I can hope for now, or can I fight this?

    Paying a CCJ after the first 30 day deadline will indeed cause it to be marked satisfied.  If you have missed the  deadline, the only recourse is to apply for set-aside(s) and you will find advice on how to do that in the NEWIE sticky second post, also you could read some threads/discussions that other posters have put up in the last couple of weeks to see what N244, witness statements and draft orders look like.

    Fight them.  They are inflated by false charges and they should have brought the whole case as one claim.  Their signs are also pants.

    Read the 'CCJ set aside' section of the NEWBIES thread 2nd post, and the recent worked example thread by @Jack5656 (username is a hyperlink to his profile and his Discussions).

    Which site?  OPS are particularly notorious pariahs in Sussex.

    Let me guess: Vantage Point?  Eastgate Wharf?

    @Coupon-mad good knowledge. Yes Sussex. Ingram crescent in Hove. Parking used to be for flats and care home then changed it to just residents. Flats could be BHCC I know care home definitely was.
    OK I will start N244 and relevant witness statement and draft order.

    Should I do this on the grounds of, inflated charges, unsuitable signage, undue stress caused by threatening letters, wasting of courts time with seperate CCJ's and using two different legal representatives,  Any other reasons that could be thrown in for good measure?
