PILON Payment?

Hi,

Can somebody help me regarding PILON payments? I work night shifts at an enhanced rate so I assume any PILON payment should be paid at that enhanced rate. Similarly, I was due to work the two upcoming bank holiday Mondays, should I be paid for this at an enhanced rate?

    What does your contract say (if anything) about PILON? What does it say about rates payable eon bank holidays?
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!

    It states - 

    1 month NB: Termination of an Assignment shall terminate your employment unless otherwise agreed in writing by the Company.

    It says that if I work bank holiday I get double pay for working the bank holiday

    When were you advised that you wouldn't be working?  Was there no notice at all?

    No, I work permanent night shifts, rate of pay just states £x with a description i.e. weekday nights, nighs bank holiday etc.
    BH were to be night shifts and yes it is double pay on a night shift.
    I am entitled to 1 month.
    I was told on Friday, basically I was suspended pending an investigation which no further action was to be taken but the client does not want me back on sight, I am employed by an employment agency.

    This is a matter between you and the employment agency - there are different terms of contracts depending on the way the agency operates. Why do you think the agency will be offering you any PILON - the term that you have quoted here doesn't suggest that they give notice or pay notice at all. What it says is that if a client terminates you, then the agency is not obliged to offer you any work - the basis for that term then depends on how you are retained by the agency. Have you actually been told that you will be getting notice? Or are you assuming that?

    That is really unusual. Have you an employment contract with the agency then? And worked for them for a long time? It seems strange that they would prefer to pay you off than find you another assignment, given that there is such demand for staff these days. But I am afraid that nobody can really advise you on the terms of the PILON as it depends on what the terms of your employment with the agency are.

    Yes, I have an employment contract with the agency, The client is a government department and the contract was specifically for that government department.

    If you are being paid PILON then I would expect it all to be paid at the regular night shift rate if that it what your rate is given in the written particulars of your employment.  I would not, however, expect them to take into account that you would have been working over the Easter Monday and May Day bank holidays.

    If your contract with the agency says you can work any shifts, then that is what counts.  If the client subsequently only asked you to only work night shifts, I doubt that is relevant.

    The fact that you are employed by an agency is massively important here.  What does the contract you have with them say about notice?  Are they giving you notice from working from the agency, and on which date?  The fact that the client has said they no longer want you does not automatically mean your contract with the agency ends; someone would really have to see the whole thing to make an informed comment.
