QDR solicitors
I recently paid off some outstanding debt with a small windfall that I got (was all spent on this). Soon after I received a text from QDR stating I owed them money for payday loans that I did not pay from 10 years ago. They just tried to call me on this. The only thing i have done is log into their website, I have not acknowledged the debt. Surely if the debt they bought is 10 years old they can not legally enforce this given as its way over the 6 year statute of limitation? Is my next step to send a cease and desist letter?

It is better to post this in the debt Free part of the forum, but if you have not paid or acknowledged the debt for over 6 years, then yes it will be statute barred. Best to send the prove it letter (link below) first to see what they come back with, and then depending on what they come back with you would send the statute barred letter. Are they showing on your credit report? If they have gone it will mean that the default was more than 6 years ago, which is a good thing as they will not be able to chase them once you say stop.

Go with SusieT`s advice here, cease and desist letter not appropriate, it must be the statute barred letter.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
