hello , have inherited 2 flats in wales above an empty shop, still waiing for probate to be granted. the properties will be sold once probate is granted.
thanks.
- can i give the tenants notice now?
- can i tell them that the intention is to give them notice once probate is granted? thus giving them longer to find somewhere else.
- if i can give notice what type shoul it be.

The reality is that the tenants don't have to leave even if you give them notice.
You are not yet the landlord so I don't think you can give them a valid notice yet anyway.
The best thing would be to have a polite conversation with the tenants to find out what their plans are and let them know your intentions, so they can start searching for a new place at their convenience.1 -
If you're planning on selling - you could sell with tenants in-situ. Flats above shops (depending on the shops) might not be easily mortgageable - so you might be appealing to investor buyers anyway, and they might be more interested with a tenant in place who's been paying rent regularly over a long period. As above - as the flats are not yet yours - there's nothing much you can do anyway. (I'm still waiting for probate from a year ago due to a caveat being placed - don't assume you'll get it until you've got it)0

Serve them notice after 24thMarch as its currently 6 months notice in Wales and should go back to normal from 24th March. From July 2022 the welsh government are having a huge overhaul of the rental system and things will get expensive for you and this includes changes to the notice periods (back to 6 months). You need mains fitted fire alarms, carbon monoxide alarms, electrical certificates etc, so you are likely going to find yourself having to sort these things even if you are selling if they are still there past July.

My advise is issue notice and get them out ASAP or sell it with the tenants in situ now.

Is there a will with a named executor?
If there is the executor powers come from the will and they should be able to act as new landlord and give notice.
