Job Contract Wording: Holiday Entitlement

Hi there,

I've recently been offered a new job and I've received the contract however I'm just trying to understand the wording of the Holiday Entitlement. Within the contract the clause reads as below:

'You are entitled to 25 days holiday per holiday year at your normal basic pay. This entitlement includes the usual public and bank holidays.'

Does this mean I'm entitled to 25 days paid holiday + the 8 'usual' public/bank holidays? So 33 paid holiday days in total?

Or is it reading the other way, meaning the public/bank holidays are included within the paid 25 day allowance? So I'd have 17 days holiday of which I could book off?

I'd appreciate any advice/clarity!

    I read it as 25-8 (there are 9 this year) and the key word is includes
    however statutory minimum is 20, so I’d go back and clarify.
    perhaps it’s badly worded.

    I read it the same as lisyloo, and that 17 days is below the stat minimum.  Get it sorted before you start the job.

    The statutory min is 5.6 weeks(28 days for a 5day worker))  BH have no meaning for statutory holiday entitlement.

    The contractual entitlement can split but must be the minimum of statutory.

    Not sure what you mean by no meaning.
    min is 28 including bank hols, so I’d say it’s very relevant to the numbers, if you have a “normal” job where bank hols are enforced as non working days.

    I read it as you have 25 bookable holidays, (you might have to use some to book a bank holiday). 

    I'm guessing it's part time?

    It is poorly worded.    On balance I would plump for it meaning 25 days of holiday and that customary holidays ("public and bank") are included in those days.
    However, if you are working 5 or more days a week, that is not sufficient for the 5.6 weeks statutory entitlement.

    You say the wording appears "within the contract the clause reads".  Is the clause headed "Holiday Entitlement"?  Is there any other wording about holidays?

    The only people who can provide clarity are the employers.  Are they UK-based themselves?
  • Thank you for all your comments. A bit of background on the job:

    It is a full time position (Mon-Fri, 40 hours a week) and it is a UK based company. It is a relatively new company so I'm guessing this clause within the contract could be badly worded/mistakenly put. Obviously, it doesn't line up with the statutory minimum (28 days) for a full time worker, so I'll definitely reach out and ask them to clarify before potentially signing.

    BH are contractual they have no meaning within the legal framework for holidays which is now 5.6 weeks.

    If they are pre allocated as days off that is a contract arrangement nothing to do with statutory legislation.

    Minimum statutory if 28 for employee working 5 or more days a week.  That may include bank holidays.
