Getting my ex of the mortgage after 13 years

  • Its a joint mortgage. So basically theres no way out of my situation. Because its down to me to provide the address and contact details of my ex for the Solicitor and court and this is something I cant do!

    It might be possible to get a judge to transfer the property to your sole name.

    The judge would need to be convinced that (1) you have made every possible attempt to contact your ex, and (2) your ex is not entitled to a share of the property. 

    You would need to find a solicitor who is experienced in dealing with this specific type of case. Not just an average solicitor from the nearest local firm. 

    It might be worth contacting solicitors who specifically specialise in property disputes, and seeing if they have the necessary experience to assist you.

    You keep focusing on the mortgage, but it also matters how the ownership was recorded on the deeds, but you can deal with both at the same time.
    As above, you need legal advice from someone with experience in this area, it isn't going to come from one of the volume conveyancing shops, and it isn't going to be cheap, but you can get this resolved through the courts with the right legal advice.

    The fact that you said nothing in your OP about making any attempt to find him.

    Have you instructed tracing agents to track him down?
