I have a number of pre-1998 student loans. I have always deferred them and for many years, the deferment was straight forward and accepted. A number of years ago, Thesis took over the "servicing" of these loans. it is a sham though. Any deferment goes to SLC who make the decision and the convoluted timescales for letters / forms etc to go back and forth is ridiculous. Around 5 years ago aged 45, they claimed i'd missed the deferment window and i had incurred "arrears". I disputed this and the matter got worse and worse. I submited a complaint to the FOS who initially found in my favour against Thesis saying I had been treated unfairly and the deferment criteria had changed. However, they did a late U turn and said actually it was SLC who were at fault. so i sent a complaint against SLC. many months later, they replied quoting i had to keep up payments etc and send in deferment forms etc. - ie basically washing their hands of it.
Thesis now say i have defaulted! nothing has appeared on my credit rating (yet!) and frankly, I am steaming mad about it. I have always earned below the threshold for repaying these loans and now, age 50, with a default against me, it could screw any chance of me getting furher credit - correct?
I see on other threads about Erudio dealing with others and responses saying their debt is "statute barred" but thats no good to me if they are going to register a default against me.
How on earth can these two companies claim to be entirely separate or culpible when clearly they are the same?? And who can i go to now to get this sorted out? More to the point, how on earth can Thesis, who have nothing to do with the loans, claim to register a default against me?? what can i do?
I am utterly furious about this!
