Hi all.
I would like to ask a question, do you have to pay a debt which is over 10 years old?
I have received a warrant of control.

What you're asking is whether you have grounds for set-aside of the underlying ccj.
I'm assuming this is a county court credit debt and not some sort of criminal fine or a magistrates court issue like council tax or tv licence arrears
The relevant questions would be
When did they obtain the ccj?
Was there a period of six years before that when you did not acknowledge the debt by payment or in writing?0 -
It was for a credit card.
CCJ was in December.
Its not been acknowledged in over 10 years.0 -
Then you have a 'defence with a prospect of success'

Assuming you didn`t receive the pre action letter and the court papers, you would likely have grounds for a set aside.Cicely41 said:It was for a credit card.

Have you moved since the card was issued, could the paperwork have gone to an old address ?
