Loans/Payday Loans

Over 10 years ago I did the stupid thing and got into some payday loans, I was in a bad situation and just generally stupid. I have received an email from PRA Group collecting for a Quick Quid loan. I have a couple of questions relating to this. Firstly due to the situation I was in at the time I don't believe I should have been accepted by them on affordability grounds so would I have a case to ask for refunds etc or has the timeframe for this expired? If I do have a case is there any guides on how to begin? I am of the belief that due to the timeframe elapsed it would be statute barred but dont know if this would affect anything? Is it worth sending PRA a provit letter? I already have an account with them thats linked to a DMP I am in.

In that DMP is a loan from Lendable which is now with Intuit, again now I look back I don't believe I should have passed affordability checks, I actually went onto the DMP a couple of months after taking the loan. Again would I have any kind of grounds to appeal/argue on this?

If anyone can advise on either of these situations I would be very grateful.

  • I should add that to the best of my memory the Quick Quid loan would have been "renewed" on a monthly basis

    Depends who the payday loan company was as a number of them went bust, others entered schemes of arrangement.

    After 10 years its a bit late to make affordability complaints, but you are right in thinking they will likely be statute barred by now.

    I assume the defaults will be long gone by now, you can send the provit letter first, then follow it up with the statute barred version after they respond.
